These Terms of Service (the “Terms”) set out the conditions for using “Misekoe” (the “Service”), provided by FREE WEB (the “Operator”).
1. Scope
By using the Service, you agree to these Terms. The Privacy Policy and the disclosure required under Japan’s Act on Specified Commercial Transactions form part of these Terms.
2. Accounts and Authentication
Store users may create or use an account through email one-time-code authentication, Sign in with Apple, LINE Login, or another method offered by the Service. LINE authentication is optional. You must keep your registration information and store settings accurate and manage your account and authentication information at your own responsibility. You must not allow a third party to use or share your authentication information.
3. The Service and Notifications
The Service lets customers respond to a survey without logging in by scanning a QR code issued by a store, and lets store users review and aggregate responses. Customers are not asked to provide their name, email address, or telephone number. Store users may receive in-app and push notifications; if LINE is connected, LINE notifications may also be sent. Notification settings can be changed in the Service or on your device. Store users are responsible for handling survey responses and using notifications appropriately.
4. Free, Standard, and the Free Trial
The Free plan is available at no charge. It includes QR-code use, survey response collection, and review of responses from the most recent seven days. The Standard plan costs JPY 1,480 per store per month, including consumption tax, and includes Standard response-review features, daily summaries, and immediate notifications for requests for follow-up, among other features.
The free trial lasts 30 days from the date the first valid customer response is received. The free trial does not automatically convert to Standard or result in a charge. The Standard subscription process proceeds only if you choose to continue with Standard and complete your application through Stripe Checkout. If you have not selected Standard when the free trial ends, your account moves to Free.
5. Payment and Charges
Standard is paid for by credit card through Stripe. Charges are subject to the terms displayed in Stripe Checkout. If you subscribe to Standard during the free trial, the current implementation sets Stripe’s trial_end based on the end time of the free trial, and no charge is made before trial_end. To meet Stripe’s acceptance requirements when necessary, the charge-start time may be adjusted by up to 48 hours from the time of application.
6. Cancellation
You can cancel Standard through the Stripe Customer Portal. You can continue to use Standard until the end of your subscription period, after which your account moves to Free. The same QR codes already issued remain usable after moving to Free or canceling Standard. We do not provide prorated refunds for the remaining portion of a subscription period, except where applicable law provides otherwise.
7. Prohibited Conduct
You must not violate laws or public order and morals; infringe another person’s rights or privacy; engage in unauthorized access or compromise security; impose excessive load on the Service; submit false responses or misuse notification features; or interfere with operation of the Service.
8. Changes to or Suspension of the Service
The Operator may change, restrict, or suspend all or part of the Service for feature improvements, maintenance, incidents, security measures, disasters, circumstances involving external services such as LINE, Stripe, or Cloudflare, or other unavoidable reasons. Where possible, the Operator will give advance notice or provide notice through the Service.
9. Disclaimers and Liability
The Service is intended to support store operations. The Operator does not guarantee business results, including sales, visitor numbers, response numbers, customer satisfaction, or the outcome of any individual response. Responses or notifications may be delayed or temporarily unavailable due to external services, communication environments, devices, or other circumstances outside the Operator’s reasonable control. Except in cases of the Operator’s willful misconduct or gross negligence, or where applicable law does not permit exclusion, the Operator’s liability is limited to the extent permitted by law.
10. User Responsibilities
You are responsible for managing your account, store information, placement and management of QR codes, review of survey responses, handling of respondents, and the permissions needed to use the Service. If your actions or inadequate management cause damage to a third party, you must address that matter appropriately.
11. Changes to These Terms
The Operator may change these Terms when necessary due to changes in law, changes to the Service, or other reasons. The Operator will give notice of the changes and their effective date, including by displaying them through the Service. If you use the Service after the changes take effect, you are deemed to have agreed to the revised Terms.
